TREATMENT FOLLOWING A CAR ACCIDENT CAN BE CONFUSING: We are under a TORT System, so Colorado Law
now punishes those at fault in an automobile accident.
If you are the one who is ticketed
(AT FAULT) in an accident, and you have been injured, you have 2 options if you want Chiropractic and/or Acupuncture
treatment:
1) Use your own Health Insurance to pay your medical bills, because your Auto Insurance
won't cover you. If you sign off on your Med-Pay and opt out of it, you may find that your medical bills won't be
paid by either your Health Insurance or your Auto Carrier--So, BUY THE MED-PAY ! It costs about $ 10 per month and
is worth it!
2) If you purchased the MANDATORY MED-PAY from your Insurance Carrier,
which ranges in coverage from $ 5,000 to $ 25,000, you can use this to pay your "at fault" medical bills. If you have a $ 5,000 Med-Pay, and there were 4 people in your car injured, they ALL get $ 5,000 worth of
Coverage just like you do!! Be aware that if you were at fault, and you use your Med-Pay to pay your Doctors,
your Insurance rates may go up...but, at least, you are getting the care you need.

IF YOU ARE THE VICTIM IN A CAR ACCIDENT:
This means that you did
NOT receive a ticket, and that someone else hit you, or Caused the accident. You have 2 options, if you have been
injured and want care:
1) You can use your Med-Pay to pay your Doctor bills, and your Insurance rates WILL NOT
go up, because the accident was not your fault. You will want to be reimbursed by the AT-FAULT driver's INSURANCE CO.,
so you may need to negotiate with them, or have a lawyer do it for you.
2) You will be required to sign a Doctor's
Lien for any bills that exceed your MED-PAY, which means that the Doctor will wait until you SETTLE with the AT Fault
person's Auto Insurance company to have your excess, IF ANY, bills to be paid. Please be aware that court
cases can be years after the accident.

LIENS, LAWYERS, and MED-PAY:
In Colorado, you will most always have to sign a Medical
Lien if you are going to treat with a Medical Doctor, Chiropractor, etc., regardless if you have Health Insurance,
Med-Pay, or an Umbrella Policy. It just means that the Doctor agrees to be paid out of any settlement money for his/her treatment.
I have found that it is easier to negotiate with your Insurance Company initially if a Lawyer is
NOT involved. The minute an Insurer sees that there is an attorney, they immediately DENY any liability, and it creates a
WAR. Patients may LOSE. Try to negotiate your settlement on your own with the help of the treating Doctor--it works better.
I've done this many times, and it is way more effective in the majority of cases. It also keeps everyone's bills
lower! Lawyers can help if you start getting abused by the Insurance Company.
If you haven't purchased a Med-Pay,
it is good to do so. Minimum Mandatory Med-Pay is
$ 5,000 per person. This coverage should cost you less than $10
per month. You can still sign a lien for amounts of treatment that exceed your Med-Pay amount, but you will be required to
start with at least $ 5,000 coverage in the beginning.
